Defining Custody

In Arizona, parents are often confused about the differences between legal custody, physical custody and parenting time:

  • Legal custody is about decision-making authority. When legal custody is joint custody, it means that parents must agree on decisions regarding school, religion and medical care for their children. With sole legal custody, one parent assumes responsibility for those decisions. There is no such thing as "full custody."
  • Physical custody (also referred to as "parenting time," visitation or access) refers to where and with whom the child will live.
