Be the Author of Your Own Divorce Decree
While divorce is never easy, having a hand in developing a plan that is workable for you and one that takes into account the needs of all involved is preferable to having the court decide the outcome for you. At the Arizona law firm of Davis Limited, we help families avoid the all-out battles that are too often a part of the divorce process by offering alternative dispute resolution services.
Phoenix Family Law Mediation and Alternative Dispute Resolution
Alternative dispute resolution (ADR) encompasses both mediation and arbitration. When you choose a mediated or arbitrated divorce procedure, attorney Greg Davis is there to be your advocate — providing legal counsel and protecting your interests.
How Mediation Works
Mediation is a service we both offer and use. As a Scottsdale mediator, Greg Davis will act as a neutral "third party" to unrepresented clients; often meeting individually with each party before bringing them together to broker an agreement. In higher conflict cases, we use mediators who are locally known and well-respected to assist us in reaching agreements. In these cases, Greg Davis acts your attorney, while your spouse would be represented by his or her own attorney. In either case, the objective of a mediation is to come to a mutually beneficial and agreed-upon settlement.
How Arbitration Works
Arbitration is another alternative to divorce litigation. While arbitration does not take place in court, both parties agree to have a local lawyer act as the judge and each party has his or her own legal representative. It is similar to a court proceeding in that the attorneys can call witnesses and bring in family law masters, such as appraisers, accountants and business evaluators, who will have the power of the court to make final decisions regarding the value of real estate or other property, as well as what a parenting plan should be.
