Scottsdale, Arizona, Prenuptial Agreement Attorney
It can feel downright uncomfortable to many couples, but a well-drafted prenuptial agreement can actually take a lot of worry out of a marriage by defining limits, goals and purposes up front. A premarital or domestic partnership agreement should protect both parties. At the law firm of Davis Limited, attorney Greg Davis can help you by drafting a prenuptial agreement that is clear, fair and enforceable.
Is it Right for You?
A prenuptial agreement is about more than, "if the marriage end, who gets what?" In fact, Arizona law already provides that whatever you owned before a marriage is yours upon divorce. In cases of second marriages, where there is a family-owned business or where one or both partners want to be protected from debt, for instance, a prenuptial agreement makes sense. Provisions that are often addressed in a "prenup" might include:
- How credit cards will be handled
- Whether you want to opt out of community property law
- Dividing income from a family business
- Filing tax returns
- Separate or joint bank accounts
- Limiting liability from one another's debts
Things that you cannot put into a prenuptial agreement include child support or child custody matters.
Domestic Partnership Agreements
Arizona does not recognize common-law marriage. Heterosexual and same-sex couples who are in or planning to enter a long-term relationship may be wise to contact a lawyer to draft a partnership agreement that defines property and financial arrangements up front.
